Hole in the Wall


Case:

Rabbi Kroll walks into Rabbi Grajower’s shiur to give the annual shabbaton speech. He notices a hole in the back wall, but ignores it. The next week, Hadar replaces KYHS in the building and they decide to fix the wall. After a few months, the new KYHS building fails miserably and KYHS is forced to return to BRS. Hadar calls Rabbi Kroll and demands that they pay them back for the wall. Is KYHS obligated to pay?

Analysis:

KYHS is not obligated to pay since they didn't take action to repair the wall themselves. This shows that they didn't mind the damaged wall and that they didn't want it repaired. Hadar decided to repair the wall because it bothered them and they shouldn't be repaid for that.
