Dear Vudes and Tus,
I understand what you said, but I wouldn't be asking this question if I thought that it was the owner that had thrown the TV. It's kinda obvious that the owner would be responsible, because he was trying to lose it. Right?
Sincerely,
DestructiveMurderer27
Dear DestructiveMurderer27,
We see why you would think so, but we can answer you in two different ways. We can tell you that it's not an intentional loss, or an Aveida Mida'at, at all, because the owner didn't even break the TV like he intended to! (Beit HaLevi) You didn't let him finish what he started. He didn't mean for the TV to be broken by you at all . We could also tell you that even if it was a mindful act, you have no right to take it. The entire principle behind an Aveida Mida'at is that you don't need to return the object to the owner, you can't just take it for yourself (Rambam). It is still the owner's object up until the point that it breaks. These are both good reasons for why we told you the ruling regarding the owner throwing his own object. Never contradict us again. We can easily trace an IP address and it will be your blood on the end of that shovel.
Sweet Dreams!
Vudes and Tus
