Zero Control Accidents Post #1


Hi guys it's Tosafot here coming at you hot from the 305. To kick off my new section of this blog, I'm gonna take a case I found on the internet and explain it according to my standards.

A man named Carlos was walking in the streets of Mexico with a bag on his shoulder. The bag contained a bunch of bricks of cocaine. Behind him was a man by the name of Juan who was bringing his new shipment of machetes. Carlos thought he saw a spider on his shoe, so he stopped in his tracks and tried to get it off. Juan walked into Carlos and the machetes punctured the bag of cocaine. Thousands of dollars of cocaine went flying everywhere. Carlos blames Juan for this.

In this case, Juan is not obligated because he had Zero Control of the Accident. There is no way he could've predicted that Carlos would've stopped and that the damage would have occurred. Since a second party's actions. in this case Carlos', helped cause the damage here, the full amount of blame can't be put on Juan, especially since he didn't necessarily need to be watching where he was going. Therefore, this was not Juan's fault.
